By accessing and using the Gorilla Energy website, you agree to these Terms of Service (“Terms”). These Terms govern your use of the website, including shopping, browsing, and account creation.

Gorilla USA Corp. (“Gorilla”) is the copyright owner of this site and no portion of this site, including but not limited to the text, images, audio or video, may be used in any manner, or for any purpose, without Gorilla’s express written permission, except as provided for herein. Without in any way waiving any of the foregoing rights, you may download one copy of the material on this site for your personal, non-commercial home use only, provided you do not delete or change any copyright, trademark or other proprietary notices. Modification or use of the material on this site for any other purposes violates Gorilla’s legal rights.

By entering this site you acknowledge and agree that any name, logo, trademark, or servicemark contained on this site is owned or licensed by Gorilla and may not be used by you without prior written approval. Gorilla will aggressively enforce its intellectual property rights to the full extent of the law. Sound, graphics, charts, text, video, information, or images of places or people are either the property of Pabst or used on this site with permission. Your use of any of these materials is prohibited unless specifically provided for on the site. All content information and materials contained in this site are provided to you “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

Orders and Payment
All purchases made on our Shopify store are processed securely through Shopify Payments or other approved payment methods. Prices are listed in USD and may include applicable taxes. You are responsible for providing accurate billing and shipping information. The financial information that you provide will be used to bill you for those products and services you have requested. By providing contact information (such as name and email address), financial information (such as account and/or credit card numbers) and demographic information (such as zip code or age), you are authorizing our store, or the firm operating the store under contract with us, to give that information to the merchant and credit card company in order to confirm and fulfill your order. We will not otherwise use or distribute your financial information without your prior approval. We will also use the contact information provided on the order form to fulfill your orders. We may also use contact data to get in touch with you when necessary.

Shipping and Return Policy
All sales are final. We do not accept returns, exchanges, or issue refunds unless required by law. Please ensure you review your order carefully before completing your purchase. If your order arrives damaged or incorrect, contact us within 7 days at [email protected] for assistance.

Mobile Terms of Service

The Gorilla Energy Drink mobile message service (the "Service") is operated by Gorilla USA Corp (“Gorilla Energy Drink”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Gorilla Energy Drink’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Gorilla Energy Drink through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Gorilla Energy Drink. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18449103862 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Gorilla Energy Drink mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Online Surveys, Sweepstakes and Contests
From time to time, we may conduct online surveys, sweepstakes and/or contests (“Promotions”). If you wish to participate in a Promotion, you may be asked for certain information about yourself including, without limitation, contact information (such as your name and email address) or demographic information (such as your zip code and age) (“Information”). We may use this Information to provide you with certain information about our company, promotional material or to contact you when necessary. Any such use shall be in accordance with our Privacy Policy. Each Promotion has its own terms and conditions and you must read and agree to any such rules prior to participating in any Promotion.

Although this site may be linked to other sites, Gorilla is not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with the linked site, unless specifically stated therein. By entering this site you acknowledge and agree that Gorilla has not reviewed all the sites linked to this site and is not responsible for the content of any off-site pages or any other site linked to this site. Your linking to any other off-site pages or other sites is at your own risk.

Claims of Infringement
Gorilla respects the intellectual property of others and requires that you do the same. To that end, Gorilla adheres to the takedown notice procedures described below in accordance with the Digital Millennium Copyright Act (“DMCA“). If you believe that your content has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide Gorilla’s Copyright Agent the following information:
DMCA Notice of Alleged Infringement (“Notice”)
Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works;
Identification of the material claimed to be infringing and a reasonable description of where the infringing work is located;
Your contact information, such as an email address, physical address, and/or telephone number;
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
